Below-market property in Dubai: a South African glossary, from sale in execution to voetstoots

In Dubai, "distress", "below market" and "off-market" are marketing labels, not legal categories, so a property is not below market until you have proved it. This glossary translates South African terms such as sale in execution, voetstoots, sectional title and levies into their Dubai equivalents, then gives a step-by-step way to verify price, title, permits and charges before any money moves.

Key takeaways

How South Africans say it, and what the Dubai equivalent is

South African property vocabulary is precise and legally loaded. Several of its terms have no neat Dubai twin, and assuming they do is how buyers misjudge risk. The table is a glossary, not a legal comparison.

South African buyers will also recognise "urgent sale", "fixer-upper" and "false bargain" from Property24, which warns that a cheap-looking urgent sale can hide repair costs (Property24). That caution transfers directly: a low asking price says nothing about what the unit needs. "Off-market" and "must sell" are used loosely in South African listings and we did not find a South African source defining them, so treat them as sales talk.

What "distress", "below market" and "off-market" mean in Dubai

Searches of the DLD, Dubai government, u.ae and Dubai legislation portal sites found no legal or regulatory definition of any of these terms (Dubai Legislation Portal%20of%202008.html)). They are market usage. DPF's working definitions, which are editorial and not official, are:

One more distinction matters to South Africans, who are used to repossessions running through the courts. Foreclosure and auction in Dubai is a specific court-supervised process, and most "distress" listings are voluntary sales that are not foreclosures at all.

The main routes to a below-market Dubai property

1. A resale at a price cut. The owner accepts less than the asking price to close quickly. The main risk is that the benchmark is missing, and that a mortgage, unpaid service charges or other debts are not disclosed.

2. An off-plan resale or assignment. The buyer of an off-plan unit sells before handover. DLD records that off-plan sales are registered in the provisional (Oqood) register within 90 days of signing, and that a developer e-NOC is needed to resell in freehold areas (DLD). We found no official figure for how much of the price must be paid before resale; that is developer-specific. The risk is outstanding instalments, developer conditions and construction progress.

3. Mortgage default and the court process. Dubai's Law No. 14 of 2008, as summarised, requires the lender to give the debtor at least thirty days' notice through the Notary Public; the execution judge then issues an attachment order if the debt is unpaid, one postponement of the auction of up to sixty days may be granted, and the sale is by public auction (Dubai Legislation Portal%20of%202008.html)). These article numbers and timelines come from a summary and the law may have been amended, so verify the full text. We could not retrieve the Dubai Courts pages on the execution stage, so we offer no step-by-step auction guide, and DLD's "Execution case" service covers evacuation, financial claims and tenancy renewals, not property auctions.

4. Off-plan buyer default. Law No. 19 of 2020 ties the developer's remedies on a buyer's default to the level of project completion, again as a summary to be checked against the text. A unit returning to the market this way may have an unclear payment history.

5. An owner who must sell, and private offers. An offer through an agent or directly from the owner that does not appear on portals. The risk is that identity, permit and title cannot be checked from an advert. DPF's distress-properties page lists properties with DPF labels, but every offer still needs independent verification.

South Africans should note one structural difference. In South Africa a bank-mandated sale or property in possession is often a recognised channel with its own agents. In Dubai, "with the bank" more often describes an owner selling a mortgaged unit, where the DLD requires a bank liability letter, manager's cheques including one in the bank's name for the outstanding debt, and release of the mortgage before registration (DLD).

How to check that a price is really below market

  1. Write down the benchmark. Building or area, unit type, bedrooms, size and period. There is no fixed threshold for "below market".
  2. Find comparable transactions. The DLD Real Estate Data portal lists transactions, and the Dubai Pulse dataset records sales, mortgages and other transactions, updated daily (DLD, Dubai Pulse). Note the extraction date if you calculate anything. DLD's own price index page says it should not be used for pricing or investment decisions, so do not use it as your benchmark.
  3. Verify the broker and the advert. DLD's licence and permit service, which uses Trakheesi, checks practitioners and permits; the Madmoun QR code on an advert shows whether it has been approved by RERA and whether the property has been sold or rented (DLD, DLD Madmoun).
  4. Confirm title, NOC and mortgage. The e-NOC from the developer is required for resale in freehold areas. We did not verify a public title-deed lookup for buyers, so confirm ownership with the seller and through the trustee office and DLD.
  5. Ask for the service charges. The DLD Service Charge Index shows RERA-approved charges by project, usage and year (DLD). This is the Dubai version of checking levies in a sectional-title scheme.
  6. Confirm the payment route. For off-plan, the Dubai REST app shows completion percentage, escrow account number and payments due (DLD). For resales, payment goes through the trustee office as DLD describes.

Buying process and costs as officially described

DLD's sale registration page lists a registration fee of two per cent of the sale value payable by the seller and two per cent by the buyer, plus administrative fees including AED 250 for the title deed certificate and AED 225 for the unified map. The trustee fee is AED 4,000 plus VAT where the sale value is AED 500,000 or more and AED 2,000 plus VAT below that (DLD). Who pays what is a matter for the contract, because the page shows only the split. The transaction is registered at a Real Estate Registration Trustee office, with Emirates ID or, for non-resident foreigners, a valid passport. The pages carry no update date, so reconfirm before signing. We do not add these into a "total cost", since bank charges and other items vary.

South Africans are used to transfer duty, bond registration and conveyancing fees, and the Dubai structure is different, so do not map one onto the other. If you plan to finance, CBUAE rules set a maximum loan-to-value of 80 per cent for an expatriate's first home up to AED 5 million and 70 per cent above, 60 per cent for second and investment homes, and 50 per cent for off-plan (CBUAE). These are regulatory maximums from a text that may have been amended; banks can lend less.

Currency, funds and residency notes for buyers from South Africa

DPF listings are in dirhams. For the rand equivalent, check the live rate on the day; we do not quote one. Exchange control is the part South African buyers most often ask about. South Africa's Reserve Bank published Exchange Control Circular No. 3/2026 on 3 March 2026 on the reforms announced in the 2026 Budget, with draft circulars covering private individual allowances (SARB). Sources we reviewed disagree on the current allowance amounts, so this guide states none. Confirm current SARB exchange control rules with an authorised dealer or adviser before you commit, use regulated banking channels only, and keep records of where your funds came from.

Tax is a separate conversation. One advisory-firm article explains that on ceasing South African tax residency you can be treated as having disposed of worldwide assets at market value, which can trigger capital gains tax without a sale (Skybound Wealth). That is an adviser's view, not official guidance, and it is not advice. Whether and how rental income and gains from a Dubai property are reported in South Africa is a question for a South African tax practitioner, so ask before buying.

On residency, DLD's Golden Visa (Investor) service cites a property value of at least AED 2 million at the time of purchase, and mortgaged property needs a bank letter (DLD). The u.ae page also gives AED 2 million as the minimum capital but differs from DLD on category and duration (u.ae). We state no duration; confirm with DLD, ICP or GDRFA when you apply.

Foreigners may acquire freehold in designated areas of Dubai under Regulation No. 3 of 2006; the original list has since been expanded, so confirm that a specific project is in a freehold zone (u.ae, Regulation No. 3 of 2006%20of%202006.html)). Listings usually give size in square feet, so convert yourself and check it against the floor plan.

FAQ: below-market property in Dubai for South Africans

Is a Dubai "sale in execution" the same as a South African one?

No. Dubai has a mortgage-enforcement route under Law No. 14 of 2008: notice through the Notary Public, an attachment order from the execution judge, and sale by public auction, as summarised from the law. Timelines can be postponed, and the text may have been amended. Do not assume Sheriff, reserve-price or deposit rules from South Africa apply; take advice from a Dubai lawyer.

Does Dubai have a voetstoots clause?

We found no verified Dubai equivalent in the official sources we used. What protects you is the contract you sign and your own inspection. Get the unit snagged or inspected, check service charges and ask a Dubai lawyer how the sale contract treats defects. A low price is not a reason to skip that step.

How do I know a Dubai property is really below market?

Compare it with registered DLD transactions for similar units in the same building or area, with the date and unit type noted. DLD open data and the Dubai Pulse dataset record transactions. DLD's price index page says it should not be used for pricing or investment decisions. If you calculate figures yourself, record the date you extracted the data.

What replaces levies and a body corporate in Dubai?

Jointly owned buildings are managed by an owners' association or the developer, and the charges are called service charges. The DLD Service Charge Index shows RERA-approved charges by project, usage type and year. A developer or association NOC confirming that charges are paid is part of a resale. Ask for it before you commit.

Can I buy off-market in Dubai safely?

It is not illegal, but it needs more checking. An unadvertised offer cannot be verified with the Madmoun QR code, so you must confirm the broker's licence, the seller's identity, the title, any mortgage and the NOC yourself. Complete through a trustee office and never pay into a personal account.

What fees does DLD show for a resale?

DLD's page lists a registration fee of two per cent for the seller and two per cent for the buyer, plus administrative fees and a trustee fee that depends on the sale value. The page shows the split, not who pays under your contract. It carries no update date, so reconfirm the amounts with DLD or a trustee office before signing.

Can I send rand to Dubai for a property purchase?

That depends on current South African exchange control rules, which we do not summarise because sources conflict on allowance amounts. Confirm current SARB exchange control rules with an authorised dealer or adviser. Use regulated banking channels, keep source-of-funds documents, and take tax questions to a South African tax practitioner.

Will buying property in Dubai give me residency?

Not automatically. DLD's Golden Visa (Investor) page cites a property value of at least AED 2 million at purchase. The u.ae page also cites AED 2 million but differs from DLD on category and duration, so we state no duration. Eligibility is decided by the relevant UAE authorities; confirm requirements with DLD, ICP or GDRFA.
